Age Discrimination And Bullying In The Workplace

It is unfortunate but age discrimination and bullying in the workplace is a reality in the United States. Although there are laws that ban and prohibit this kind of behavior, the number of workers who have filed charges with the Equal Employment Opportunity Commission (EEOC) is increasing every year.

As baby boomers age cross their 50s, this discrimination is increasing all the more. In fact, some of the older generation have managed to hire attorneys to file charges with the EEOC; but this is a luxury that many older workers do not have. In addition, many people over 50 find it difficult to prove age discrimination because the law applies to only workplaces with more than 20 employees.

The saddest part is that most employers know the laws against age discrimination but have learned to use the loopholes to their benefit. It is a known fact that older workers increase costs for employers by way of salary increments earned over the years, bonuses, pensions and healthcare benefits. If older employees are removed, all these additional costs can be removed for the employers.

Today, employers do not give too much importance to loyalty or productive work. They are more worried about the bottom line. It is ironic that older workers have years of experience to rise to the zenith of their professions but have still managed to bring themselves down in their employers' eyes and minds.

In 2008, the EEOC granted around $82.8 million as compensation for age discrimination. However, the claim amounts are much higher because this figure does not take into consideration the settlements that occur during a lawsuit.

In a ruling on June 18, 2009, the US Supreme Court ensured that age discrimination would continue to be followed by employers more than any other type of discrimination. Older workers have to prove that age was not just a reason but also the main motive when it comes to employer's action. This is practically impossible to prove in majority of cases.

Now with the global recession, older workers are facing the brunt as companies are resorting to employee reduction. In fact, it is believed that the unemployment rate is the highest since the Great Depression of the 1930s. So, the thousands and thousands of older workers are left with no future job prospects as companies are unwilling to hire aged workers.
