Racial Discrimination And Workplace Applications

Racial discrimination can be defined as an action or attitude that can be conscious or unconscious and looks to demean or subjugate a person based on his race. The US Civil Rights Commission states that racial discrimination can take place either at individual or institutional level.

In 2008, the Equal Employment Opportunity Commission received 33,937 cases of racial discrimination and managed to resolve 28,321 cases while recovering monetary compensation of $79.3 million for the victims.

At institutional level, it has been seen that groups of people individuals belonging to a certain racial profile are discriminated based on their skin color or appearance. These taxonomic differences are believed to be indication of the level of intelligence, sexuality and morality. However, this belief is completely incorrect.

Racial discrimination can also take place at a workplace. This discrimination can occur to people who are already working for the organization or people who apply for jobs.

The good news is the Title VII of the Civil Rights Act offers protection against racial discrimination. However, this law applies only to workplaces that have more than 15 employees. This law forbids discrimination based on a person's race, characteristics connected to his race, and marriage to or friendship with someone from a particular race or group. In addition, Title VII also forbids discrimination founded on stereotyping of people based on their race, characteristics, or abilities.

When it comes to workplace application for a job, the employer has the right to ask a person's race but only for compliance. This information cannot be used to deny the person a job if he has all the necessary qualifications and experience for the position. In addition, if an employee from a particular race or ethnicity is hired for a position, he cannot be segregated or kept hidden from clients and customers. Also, employees cannot be grouped together based on their race.
