Gambling in America continues to gain in popularity despite a lot of opposition from different sections of society. For instance, commercial casinos have generated 354,000 jobs in 2006. |
Nevada is the only state where casino-style gambling is permissible and is legal statewide. All other states that permit casino-style gambling limit it to small places like Atlantic City, New Jersey, Mississippi or Native American reservations.
The Federal Wire Act forbids online gambling. The objective of this law was to reduce sports gambling. But it extends to online gambling too as the internet is operated through wires. However, American authorities can police only casinos and other gambling venues based in the US. Whereas, online gambling websites are operated from countries where they are legal and legally established. Many gambling sites contend that 80 percent of their revenue comes from US consumers.
The Unlawful Internet Gambling Enforcement Act of 2006 did not specifically object online gambling. Instead, it prohibited financial transactions involving online gambling service providers. Offshore gambling providers reacted by shutting down their services for US customers.
In 2006, the Congress passed a law forbidding American banks from making transactions with online gambling sites. This means they can accept money from the bettors via cash transfer or Swiss bank account. However, many gambling sites have managed to find loopholes. The player could legally use his credit card to fund his gambling account. However, the charges mentioned in the credit card statement would show a fake company that did not exist.
So, one can say that online gambling in the US is legal per se. However, it is illegal to transfer money from a bank account to an online gambling account. Similarly many countries have passed laws to make online gambling illegal. Some countries that have passed these laws are Russia, Israel and Australia.
