Traffic law can be broken into two types. These are violations and infractions. The different between the two is that violations are more severe. Infractions are essentially offences. Accordingly, they are not considered as crimes. |
Motorists who are guilty of infraction are usually fined. Violations on the other hand are described as criminal offences. There are many different types of traffic violations. However, such serious traffic violations as DUIs (Driving under the influence of alcohol), speeding, failing to obey road signs and DWI (Driving while impaired/intoxicated) are described as felonies or misdemeanors. Motorists charged with these violations are treated like criminals. They are subjected to bookings as well as jail processes. They have the right a lawyer and also to trial by a jury. In most cases, motorists are charged with felonies and misdemeanors where the traffic violations resulted in injuries to innocent passengers and motorists or damage to property. You should understand that it is possible for an offense to move from being an infraction and become a traffic violation. This however depends on certain circumstances. For example, running stop signs can be termed as an infraction. However, if your running the stop signs resulted in you hitting and damaging someone’s car or knocking down an innocent passenger causing injury or death in the process, the offense ceases to be an infraction. Felonies are considered to be serious crimes. In the event that you are convicted of a felony, at the very minimum you could be imprisoned. What is more, you could also be handed the death sentence.
