You are out on a Friday night with your friends. You take a few drinks but you don’t consider yourself drunk. Consequently, you decide to drive yourself home. Somewhere along the way, you are stopped by the police and they ask to draw blood for dui. |
When police suspect that you are driving under the influence of alcohol, they may either ask you to use a breathalyzer or ask for a blood test. The blood test measures BAC (Blood Alcohol Content). In the event that you are convicted of dui, the test acts as evidence.
However, you cannot refuse to draw blood for dui. In some states, the police offer individuals two choices. Either submit to breath tests or be forced to provide blood samples. Where the motorists refuse to submit to the breath test, police obtain warrants so as to get a sample of the motorist’s blood. Depending on the state where one is in, one may either be taken to a hospital for trained medical professional personnel to draw the blood. Conversely, the policeman, without any formal training, may draw the blood. Refusing to draw blood for dui has serious consequences in some states. For instance, in Arizona, motorists have their licenses confiscated for twelve months for refusing to submit to a blood test. The police may prefer blood over breath tests. This is because unlike blood test results, breath tests results are easily challenged in court. When it comes to drawing blood for dui, motorists have no choice. It is the police who have the authority to make the decision.
